InProcessOut, LLC Notices, Terms, and Conditions

InProcessOut, LLC owns and operates “theflynoshop.com”. “theflynoshop.com” is an online store owned and operated in the United States. All products are shipped from the US to US destinations unless prior arrangements have been made by the buyer. InProcessOut, LLC may update or change the below terms, conditions, policies, and notices at any time and without notice.

 FPV Rules and Regulations

The use and operation of FPV radio equipment (such as UHF long range systems or video transmission equipment) in the USA and many other countries may require a license and some countries may forbid its use entirely. In the USA, you will need a “HAM” amateur radio license. It is your responsibility to ensure that the use of products you purchase from InProcessOut, LLC meet the requirements imposed by your government’s rules and regulations for RF devices. Do not purchase products from InProcessOut, LLC if you are unsure of the government requirements or are not able to comply with them. InProcessOut, LLC cannot be held responsible for your actions under any circumstance, including but not limited to if you use products purchased from InProcessOut, LLC in violation of your government’s regulations.

  1. Warning Notice
    InProcessOut, LLC  is not responsible or liable for any injuries caused by any products purchased. You acknowledge that you fully understand the inherent danger involved when operating multi-rotor and other models. Spinning propellers can cause severe injury. Never work on your models with mounted propellers
  2. Warranty / Liability
    InProcessOut, LLC  will provide warranty replacement on items we find were “non-functional” due to manufacturing defects. For any replacement claim, you must contact InProcessOut, LLC  via email. InProcessOut, LLC  is not liable in case you cause injury to yourself and/or others or if you damage or destroy property with any of the products you purchased and/or otherwise received from us.
  3. Faulty Items
    If an item you received from InProcessOut, LLC  is deemed to have been faulty as determined in the sole discretion of InProcessOut, LLC  (“Faulty Item”), InProcessOut, LLC  may replace the Faulty Item only. InProcessOut, LLC will not be liable for equipment that might have been lost and/or damaged as a result of the Faulty Item.
  4. Incorrectly Published Product Details
    InProcessOut, LLC  is not liable for any issues that may result from incorrectly published product details on the theflynoshop.com website.
  5. Returns
    All returns must have received prior written authorization and a Returned Merchandise Authorization (“RMA”) number from theflynoshop.com. The RMA number must be displayed on the outside of the box and inside of the package. Items returned without RMA number will not be accepted. In most cases, InProcessOut, LLC  will allow defective merchandise to be returned for an exchange only. For merchandise that a customer wants to either return in exchange for a different item or for a refund, InProcessOut, LLC  will require the item to be in “as new” condition with all original packaging, cabling, manuals, etc. included. InProcessOut, LLC  will require a 15% re-stocking fee for returned merchandise. Customers are responsible for return shipping postage of returned items and items must be packed in a way that prevents shipping damage. No items are accepted for exchange or return after 15 days of the purchase date.
  6. Shipping Terms & Conditions
    1. You accept USPS and all other mail carriers theflynoshop.com offers (“Mail Carrier(s)”) as reliable mail carriers and InProcessOut, LLC carriers of choice
      When you select USPS mail service, InProcessOut, LLC will send your packages with United States Postal Service (“USPS”) Priority Mail. Mail service types that typically provide full tracking information to your location may sometimes not show any information beyond the USPS receiving the package. InProcessOut, LLC has no influence or control over the internal processes of USPS or the local postal system of your country. InProcessOut, LLC cannot be held liable for any mistakes made by USPS or your local country’s postal service.
    2. Lost packages
      If the tracking information for your package shows receipt by any of InProcessOut, LLC ‘s mail carriers, InProcessOut, LLC is not responsible if your package never arrives at your location. No refunds will be provided if your package is lost in the mail system either in the USA or in your destination country. Almost all packages sent by InProcessOut, LLC reach their recipient.
    3. Mail service delays
      The delivery time frames provided are averages for most mail pieces. InProcessOut, LLC is not responsible if a Mail Carrier or your local country’s postal service delays the arrival of your package due to custom holds or other issues. InProcessOut, LLC does not provide refunds in case your package is delayed.
  7. Lifetime Replacement Plan
    1. The Lifetime Replacement Plan offers the replacement of a damaged frame to the claimant. The claimant agrees to pay a deductible at a rate set by InProcessOut, LLC. The claimant also agrees to pay for shipping of the replacement product based on the shipping rates determined by InProcessOut, LLC.
    2. The replacement will only contain the frame components and no other materials that may be included with the frame when purchased though the traditional purchase process, which includes but is not limited to using the theflynoshop.com “Checkout” page.
    3. The claimant must ship at their own expense the original frame to InProcessOut, LLC. InProcessOut, LLC will only send the frame components once the request is approved and the original product is returned. If the product is in multiple pieces, the majority of the product must be included in the return.
    4. The Lifetime Replacement Plan is offered as a free service that can be changed or canceled at anytime. InProcessOut, LLC can decide at its discretion whether to honor a Lifetime Replacement Plan request.
    5. By replacing the requested product, InProcessOut, LLC admits to no fault or defect in the fabrication or production of the product.
    6. Typical reasons InProcessOut, LLC would deny a replacement:
      • Excessive request in a short period of time
      • Product no longer exists and no comparable product is available
      • The returned submission does not include the majority of the product
      • There is no visible damage to the original product
      • Almost all requests are approved

       

    7. The time required to for a replacement product to be issued is varied and based on a number of factors, included but not limited to out-of-stock products, backordered products, InProcessOut, LLC employees’ schedules, etc 
    8. In order to participate in the Lifetime Replacement Plan the follow process must be followed:
      • Claimant must complete the Lifetime Replacement Plan Request form
        • The Lifetime Replacement Plan request form is only available to users. In order to access the form, the claimant must either login or sign up for a theflynoshop.com account
        • Once the claimant is logged into theflynoshop.com, the option will be available to access and complete the Lifetime Replacement Plan request form
      • Claimant must agree to the Lifetime Replacement Plan Terms and Conditions
        • By agreeing to these conditions, the claimant is eligible to participate in the Lifetime Replacement Plan
      • Claimant must pay the deductible and shipping cost at the time of the request
        • If the request is approved, the new product will be sent
        • If the request is denied, the deductible and shipping cost will be refunded
      • Claimant must mail the original product to the address provided by the Lifetime Replacement Plan request form
        • Once the original product is mailed to InProcessOut, LLC relinquishes ownership of the product to InProcessOut, LLC
        • The claimant assumes all costs for shipping of the original product InProcessOut, LLC
        • The product will not be sent regardless of approval until the original product is received
